Cell Phones And Negligent Drivers

Did you know that if you are involved in an accident while talking on your cell phone you can be sued? What’s more if you are talking to your employer at the time, he can be sued as well.

Yoon was a 15 year old girl who was struck by a car and fatally injured while walking along the shoulder of the road. Yoon’s estate filed suit claiming the driver was negligent in driving inattentively while talking on the cell phone. The driver’s employer, a law firm, was also named in the suit. Suit against the law firm was under a respondeat superior theory of liability, as the driver was making a business call at the time of the incident.

The Law Firm settled before trial for an undisclosed amount. A jury awarded the plaintiff over $2 million against the driver.

Use your cell phone responsibly. Always be attentive when you drive. You do not want to put your life or the lives of others at risk.
